Many RTOs are held in a trust structure for asset-protection and tax reasons - but the structure has to be compliant with ASQA's requirements in its own right, not just commercially convenient. Where the trust arrangement isn't properly documented or doesn't align with who ASQA has registered as the legal entity operating the RTO, it can complicate - or stall - a future sale.
We review existing trust structures for RTO-specific compliance gaps, and advise on setting one up correctly from the outset so it doesn't become an obstacle when it's time to sell.
